2. Scope and Zambia Data Protection Act
This policy explains how we collect and use personal data when you visit our website, submit a form, or communicate with us. We aim to comply with the Zambia Data Protection Act No. 3 of 2021 and related guidance from the Office of the Data Protection Commissioner (DPC).
Registration with the DPC may be required for certain processing activities. Where applicable, we will complete registration and publish our registration details here.
3. Personal data we collect
- Contact and booking forms: name, email, phone (where provided), interest area, and your message or visit details.
- Newsletter sign-up: email and optional name when you opt in.
- Technical and usage data: if you accept analytics cookies, we collect aggregated page views and device/browser information via Google Analytics 4. We do not sell personal data.
- Maps: when you use embedded Google Maps on our contact or farm visit pages, Google may process technical data according to its own policies.
4. How we use your data
We use personal data to:
- Respond to enquiries and schedule trainings or farm visits.
- Send operational updates about programs you joined or requested.
- Improve website content and understand aggregate visitor trends (with consent).
- Meet legal, accounting, or regulatory obligations where required.
5. Legal bases for processing
Depending on the activity, we rely on:
- Consent — newsletter sign-up, contact/booking forms (via the checkbox on each form), and optional analytics cookies.
- Contractual necessity — delivering training or visit services you have requested.
- Legitimate interests — responding to unsolicited enquiries, securing our website, and maintaining business records, balanced against your rights.
6. Service providers (processors)
We use trusted third parties who process data on our instructions. These may include:
- Web hosting (cPanel) — serves the static website and PHP form handler on our domain.
- Supabase — optional secure database storage for form submissions (may be hosted outside Zambia).
- Email delivery — PHP mail on our hosting server and/or transactional email providers to notify our team of new leads.
- Google Analytics — only loaded if you accept analytics cookies.
- Google Maps — embedded maps on contact and booking pages.
Processors are bound by contract or terms to protect data and use it only for the services they provide to us.
7. International transfers
Some providers may store or process data in countries outside Zambia (for example the United States or European Union). Where required, we rely on appropriate safeguards such as standard contractual clauses or equivalent protections offered by the provider.
8. Retention
We keep form submissions and related correspondence for as long as needed to operate our programs, resolve disputes, and meet legal requirements — typically up to three years after our last interaction unless a longer period is required by law. Analytics data is retained according to Google's settings (default 14 months unless configured otherwise).
9. Security
We apply reasonable administrative and technical measures, including HTTPS, access controls on our database, and rate limiting on form submissions. No online service is completely secure — please do not send payment card details through unsecured channels.
10. Your rights
Under the Zambia Data Protection Act, you may have the right to:
- Request access to personal data we hold about you.
- Request correction of inaccurate data.
- Request deletion where applicable.
- Object to or restrict certain processing.
- Withdraw consent at any time (without affecting prior lawful processing).
To exercise these rights, email happyfishfarmers@gmail.com with enough detail for us to verify your request. We respond within a reasonable period as required by law.
You may also lodge a complaint with the Office of the Data Protection Commissioner in Zambia if you believe your rights have been infringed.
11. Cookies
Essential: session data used for form rate limiting on the server — required for the site to function safely.
Analytics (optional): Google Analytics cookies are only placed if you click "Accept analytics" on our cookie banner. You can decline and still use the site. To change your choice later, clear site data in your browser or contact us.
See also our Terms of Use for general site rules.
12. Marketing communications
We send newsletters and updates only when you opt in via the form checkbox. You may unsubscribe using the link in any marketing email or by contacting us.
13. Children
This site is not directed at children under 16. If you believe we collected a child's data in error, contact us and we will delete it promptly.
14. Changes to this policy
We may update this policy from time to time. Material changes will be reflected with a new "Last updated" date at the top of this page.
